MineFlo Terms of Service

Effective date: 2 June 2026

1. Who Can Use MineFlo

To use MineFlo, you must:

Be at least 18 years of age
Be authorised by your employer or organisation to use the platform
Provide accurate and complete information when creating your account
Keep your login credentials secure and confidential
Not impersonate another person or misrepresent your affiliation with an organisation

2. Your Account

You are responsible for all activity that occurs under your account. Your organisation’s administrator manages user access and permissions. We may suspend or terminate accounts that violate these terms.

If you believe your account has been accessed without authorisation, please report it immediately. To request account deletion, contact support@mineflo.io.

3. How MineFlo Works

MineFlo is a project management platform designed for mining shutdown and maintenance operations. Key features include:

Work order management, scheduling, and Gantt chart tracking
Daily team and crew assignments
Equipment, vehicle, and radio registers
Document management (JHAs, permits, handover reports)
Activity logging with notes and photos
Resource management and site configuration
Multi-site, multi-company workspace management
Site maps and location tracking
Reports and analytics

IMPORTANT: MineFlo is a project management tool to assist with planning and coordination. It does not replace professional engineering judgement, safety assessments, or regulatory compliance obligations. You and your organisation remain solely responsible for the accuracy of data entered and decisions made using the Platform. MineFlo is not a safety-critical system.

While we strive for accuracy, MineFlo does not guarantee the accuracy of data entered by users. You are responsible for verifying the correctness of information within the platform.

4. Your Content and Data

Your organisation retains ownership of all data and content created within MineFlo. By using the platform, you grant us a limited licence to store, process, and display your content solely for the purpose of providing the service.

You are responsible for ensuring that the content you upload is accurate, lawful, and does not infringe on any third-party rights.

5. Acceptable Use

You agree not to:

Use MineFlo for any unlawful purpose
Use MineFlo in a manner that violates workplace health and safety laws or regulations
Attempt to gain unauthorised access to other accounts or systems
Interfere with or disrupt the platform’s operation
Upload malicious software, viruses, or harmful code
Scrape, crawl, or harvest data from the platform
Reverse-engineer, decompile, or disassemble any part of MineFlo
Share your account credentials with unauthorised individuals
Use the platform to store content unrelated to its intended purpose

6. Subscription and Billing

MineFlo is billed on a per-site, monthly subscription basis.
Your organisation’s administrator manages the subscription and billing details.
We will provide at least 30 days’ notice before any price changes take effect.
A grace period may be provided for overdue payments before access is suspended.
Pricing, plan limits and any trial period are set out in the quote or subscription agreement provided to your organisation.

7. Refunds and Cancellation

You may cancel your subscription at any time through your company administrator. Upon cancellation:

You retain access until the end of the current billing period
Your data is retained for 90 days after the subscription ends
After 90 days, data is permanently deleted from our active systems within 30 days

Refunds are considered on a case-by-case basis for annual subscriptions. Contact support@mineflo.io for refund requests.

8. Intellectual Property

The MineFlo name, logo, branding, and platform are owned by Hodl Labs Pty Ltd. Your organisation’s data, content, and documents belong to your organisation. These terms do not transfer any intellectual property rights between parties.

9. Third-Party Services

MineFlo integrates with third-party services including Cloudflare (hosting and security), Leaflet (mapping), and various open-source libraries. We are not responsible for outages, changes, or issues caused by third-party services.

10. Termination

We may suspend or terminate your access if you violate these terms.
Your organisation’s administrator can cancel the subscription at any time.
After cancellation, we retain your data for 90 days before deletion.
You can request immediate account deletion by contacting support@mineflo.io.

11. Disclaimers

MineFlo is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that:

The Platform will always be available, uninterrupted, or bug-free
Data imports will always be processed without errors
Scheduling, Gantt charts, or reports will be free of calculation errors
The Platform will meet all regulatory requirements for your specific jurisdiction or industry

MineFlo is a project management tool, not a safety-critical system. It does not replace engineering judgement, formal safety management systems, or regulatory compliance processes. Your organisation is solely responsible for ensuring workplace safety and regulatory compliance.

12. Limitation of Liability

To the maximum extent permitted by law, Hodl Labs Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of MineFlo, including but not limited to loss of data, project delays, equipment damage, personal injury, or loss of profits.

Our total liability is capped at the amount you have paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Hodl Labs Pty Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of MineFlo, your violation of these terms, or your organisation’s failure to comply with applicable laws and regulations.

14. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of any material changes via the platform or by email before they take effect. Continued use of MineFlo after changes constitutes acceptance of the updated terms.

15. Dispute Resolution

If you have a dispute with MineFlo:

Contact us at support@mineflo.io — we will try to resolve it informally within 14 days
If we cannot resolve the dispute informally, either party may refer it to mediation administered by the Resolution Institute (www.resolution.institute)
If mediation fails, either party may pursue the matter in the courts of Western Australia

We encourage resolution through dialogue before formal proceedings.

16. Governing Law

These terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
